Nors procesas gali atrodyti formalus ir \u201epopierinis\u201c, jis saugo abi puses nuo rizik\u0173: neai\u0161ki\u0173 \u012fsipareigojim\u0173, pasl\u0117pt\u0173 suvar\u017eym\u0173 ar net neteis\u0117to turto perleidimo. \u017demiau \u2013 svarbiausi aspektai, kuriuos verta suprasti prie\u0161 \u017eengiant \u012f notaro biur\u0105.<\/p>\n<h2>Kas yra notarin\u0117 NT pirkimo\u2013pardavimo sutartis<\/h2>\n<p>Notarin\u0117 nekilnojamojo turto pirkimo\u2013pardavimo sutartis \u2013 tai notaro patvirtintas susitarimas, kuriuo pardav\u0117jas perduoda pirk\u0117jui nuosavyb\u0117s teis\u0119 \u012f konkret\u0173 NT objekt\u0105, o pirk\u0117jas \u012fsipareigoja sumok\u0117ti sutart\u0105 kain\u0105. Notaro patvirtinimas rei\u0161kia, kad sandoris sudaromas laikantis \u012fstatym\u0173, o sutarties turinys atitinka privalomus formos ir informacijos reikalavimus. Praktikoje tai yra pagrindinis dokumentas, kurio pagrindu v\u0117liau registruojama nuosavyb\u0117 Registr\u0173 centre.<\/p>\n<p>\u0160i sutartis paprastai apima esmines s\u0105lygas: sandorio \u0161alys, turto identifikacija (unikalus numeris, adresas, plotas, paskirtis), kaina, atsiskaitymo tvarka, turto perdavimo momentas, \u0161ali\u0173 patvirtinimai d\u0117l suvar\u017eym\u0173 ir tre\u010di\u0173j\u0173 asmen\u0173 teisi\u0173. Taip pat da\u017enai aptariami deklaravimai apie komunalinius \u012fsiskolinimus, nuomininkus, bendratur\u010di\u0173 teises, taip pat atsakomyb\u0117s ir gin\u010d\u0173 sprendimo klausimai. Jei kyla abejoni\u0173 d\u0117l sandorio teis\u0117tumo ar \u0161ali\u0173 valios, notaras gali papra\u0161yti papildom\u0173 dokument\u0173 ar net atsisakyti tvirtinti sutart\u012f.<\/p>\n<h2>B\u016btini dokumentai ir \u0161ali\u0173 pareigos pas notar\u0105<\/h2>\n<p>Pagrindinis dokument\u0173 \u201estuburas\u201c paprastai susideda i\u0161 \u0161ali\u0173 asmens dokument\u0173 ir NT objekto duomen\u0173. Notarui reikia ai\u0161kiai identifikuoti, kas parduoda ir kas perka, bei koks turtas yra perleid\u017eiamas. Da\u017eniausiai notaras pats gauna dal\u012f informacijos i\u0161 registr\u0173, ta\u010diau kai kuriais atvejais prireikia papildom\u0173 pa\u017eym\u0173 ar dokument\u0173, ypa\u010d jei situacija nestandartin\u0117 (pavyzd\u017eiui, paveld\u0117jimas, dovanojimas, bendroji nuosavyb\u0117, hipoteka).<\/p>\n<p>Pardav\u0117jo pareiga \u2013 pateikti teising\u0105 informacij\u0105 apie turt\u0105 ir jo b\u016bkl\u0119: ar n\u0117ra are\u0161t\u0173, hipotek\u0173, servitut\u0173, nuomos sutar\u010di\u0173, ar n\u0117ra tre\u010di\u0173j\u0173 asmen\u0173 teis\u0117s naudotis turtu. Jei turtas priklauso keliems bendratur\u010diams, reikalingas j\u0173 dalyvavimas arba tinkamas atstovavimas. Taip pat aktualu sutuoktini\u0173 re\u017eimas: jei turtas yra bendroji jungtin\u0117 sutuoktini\u0173 nuosavyb\u0117, paprastai reikalingas sutuoktinio sutikimas arba dalyvavimas sandoryje.<\/p>\n<p>Pirk\u0117jo pareiga \u2013 pasiruo\u0161ti atsiskaitymui ir \u012fvertinti finansavimo s\u0105lygas, jei turtas perkamas su banko paskola. Jei dalyvauja bankas, da\u017enai atsiranda papildomi dokumentai (paskolos sutarties s\u0105lygos, hipotekos dokumentai, banko reikalaujami \u012fsipareigojimai). Pirk\u0117jui taip pat verta i\u0161 anksto patikrinti, ar sutampa faktin\u0117 turto b\u016bkl\u0117 su registruota (pvz., ar n\u0117ra ne\u012fregistruot\u0173 pertvarkym\u0173), nes tai gali tur\u0117ti \u012ftakos tiek sandoriui, tiek v\u0117lesniam naudojimui ar draudimui.<\/p>\n<h2>Sutarties pasira\u0161ymas, atsiskaitymas ir terminai<\/h2>\n<p>Sutarties pasira\u0161ymas paprastai vyksta notaro biure sutartu laiku, kai abi pus\u0117s (ar j\u0173 atstovai) atvyksta su reikalingais dokumentais. Notaras supa\u017eindina \u0161alis su sutarties turiniu, paai\u0161kina esmines s\u0105lygas ir teisinius padarinius, o \u0161alys patvirtina, kad supranta ir sutinka. \u0160iame etape svarbu neskub\u0117ti: jei kyla klausim\u0173 d\u0117l formuluo\u010di\u0173 (pvz., perdavimo termino, defekt\u0173 atsakomyb\u0117s, avanso\/u\u017estato), geriau juos i\u0161spr\u0119sti iki pasira\u0161ymo.<\/p>\n<p>Atsiskaitymas u\u017e NT gali vykti \u012fvairiais b\u016bdais, ta\u010diau prakti\u0161kai saugiausi sprendimai yra bankinis pavedimas, depozitin\u0117 (notaro) s\u0105skaita arba banko paskolos i\u0161mok\u0117jimas pagal sutartas s\u0105lygas. Da\u017enai sutartyje numatoma, kada laikoma, kad kaina sumok\u0117ta, ir kas laikoma atsiskaitymo \u012frodymu. Taip pat aptariama, kada pirk\u0117jui perduodami raktai, dokumentai, skaitikli\u0173 rodmenys, ir nuo kada pirk\u0117jas prisiima i\u0161laidas (komunaliniai mokes\u010diai, draudimas, prie\u017ei\u016bra).<\/p>\n<p>Terminai yra kriti\u0161kai svarb\u016bs: sutartyje gali b\u016bti nustatytas turto perdavimo\u2013pri\u0117mimo akto pasira\u0161ymo terminas, galutinis atsiskaitymo terminas, \u012fsipareigojimai i\u0161sikelti, i\u0161registruoti deklaruot\u0105 gyvenam\u0105j\u0105 viet\u0105 (jei aktualu), pa\u0161alinti daiktus ir pan. Jei atsiskaitymas vyksta dalimis (pvz., avansas + likutis), b\u016btina ai\u0161kiai apibr\u0117\u017eti, kas nutinka nevykdant \u012fsipareigojim\u0173: delspinigiai, sutarties nutraukimas, u\u017estato netesybos ar kitos pasekm\u0117s. Kuo tiksliau tai \u012fra\u0161yta, tuo ma\u017eesn\u0117 gin\u010d\u0173 rizika.<\/p>\n<h2>Nuosavyb\u0117s registravimas Registr\u0173 centre po sandorio<\/h2>\n<p>Po notarinio sandorio nuosavyb\u0117s teis\u0117 paprastai turi b\u016bti \u012fregistruota Nekilnojamojo turto registre, kur\u012f tvarko Registr\u0173 centras. Da\u017enu atveju notarai pasir\u016bpina duomen\u0173 pateikimu Registr\u0173 centrui elektroniniu b\u016bdu, tod\u0117l pirk\u0117jui nebereikia atskirai \u201ene\u0161ti popieri\u0173\u201c. Vis d\u0117lto verta pasitikslinti, kaip konkre\u010diu atveju bus atliekamas registravimas ir per kiek laiko planuojama gauti patvirtinim\u0105.<\/p>\n<p>Registravimas svarbus ne tik \u201ed\u0117l formalumo\u201c \u2013 jis suteikia vie\u0161\u0105 ir oficial\u0173 patvirtinim\u0105, kad b\u016btent pirk\u0117jas yra teis\u0117tas savininkas. Iki \u012fregistravimo gali b\u016bti sud\u0117tingiau atlikti tam tikrus veiksmus: pvz., sudaryti naujas sutartis su paslaug\u0173 tiek\u0117jais, \u012fkeisti turt\u0105, parduoti j\u012f toliau ar spr\u0119sti klausimus su bendrija\/administratoriumi. D\u0117l to po sandorio verta sekti, ar registracija atlikta, ir i\u0161sisaugoti gautus patvirtinimus.<\/p>\n<p>Jeigu sandoryje yra hipoteka ar kiti suvar\u017eymai (pvz., banko reikalavimai), Registr\u0173 centre paprastai registruojami keli susij\u0119 \u012fra\u0161ai: nuosavyb\u0117s pasikeitimas ir \u012fkeitimas (hipoteka). Tokiais atvejais ypa\u010d svarbu, kad visi dokumentai b\u016bt\u0173 suderinti tarpusavyje, o registravimo seka atitikt\u0173 finansuotojo s\u0105lygas. Jei pastebite neatitikim\u0173 registre (pvz., neteisingi duomenys apie plot\u0105, dalis ar suvar\u017eymus), klaidas verta kuo grei\u010diau taisyti, nes v\u0117liau jos gali trukdyti atliekant kitus teisinius veiksmus.<\/p>\n<p>Notarin\u0117 nekilnojamojo turto pirkimo\u2013pardavimo sutartis yra daugiau nei formalumas \u2013 tai sandorio saugumo karkasas, padedantis ai\u0161kiai susitarti d\u0117l kainos, termin\u0173, atsiskaitymo ir turto perdavimo, o v\u0117liau skland\u017eiai \u012fregistruoti nuosavyb\u0119 Registr\u0173 centre. Geriausi rezultatai pasiekiami tada, kai abi pus\u0117s i\u0161 anksto pasiruo\u0161ia dokumentus, atvirai aptaria rizikas ir sutarties s\u0105lygas, o pas notar\u0105 ateina ne \u201epasira\u0161yti\u201c, o s\u0105moningai patvirtinti ai\u0161k\u0173 susitarim\u0105.
